Property Use Agreement

This Property Use Agreement to grant licensed approval to ride on the river bottom of the Alapaha River only when dry, is made and effective immediately after final approval by and between Suwannee River Water Management District 925 County Road 49 Live Oak Florida 32060 and only registered, licensed permit holders.

Owner is Suwannee River Water Management District the authorized party to enter into this Agreement with respect to certain real estate described as follows: Alapaha River bottom only when dry.

NOW, THEREFORE, the parties agree as follows:

1. License Granted
Owner hereby grants to Licensee a limited riding license, as set forth here, to enter the Property for the purpose of recreational riding of ATVs, Jeeps, other 4 wheel drive autos. Licensee understands and agrees that Licensee shall be solely responsible for coordinating and cooperating with any other riders on the property. Owner shall not be responsible for any damage or injury caused by anyone else on or about the Property regardless of whether the person is authorized to be on the Property. This license shall be in effect only during the time the Alapaha River bottom is dry. A new license shall be purchased each year to have authorization to ride on said property.

2. Fees
In consideration of the rights granted in this Agreement, Licensee shall pay Owner a fee of $100.00 per vehicle. If licensee has more than one vehicle, they will have the option to purchase a permit for each vehicle, or permit may be transferable between vehicles as long as the purchasing Licensee is in ownership of the vehicle.

3. Compliance with Law
Licensee represents and warrants that while on or about the Property, Licensee and Licensee’s guests (if authorized) shall comply with all laws and regulations applicable to the activities to be conducted by Licensee pursuant to this Agreement. By way of example, and not as a limitation, Licensee shall have all licenses and permits required for such activities, and shall comply with all rules establishing permissible riding times.

4. Entry and Exit, Non-interference
A. Licensee shall enter and exit the Property only at such places that Licensee has land owners permission. The Owner will not be responsible for providing public access for Licensee to ride on the Alapaha River bottom.

B. Licensee agrees that Licensee will exercise any rights granted in this Agreement in any manner that would interfere with or cause injury to the Property or Owner’s use of the Property. Provided that Licensee performs Licensee’s obligation in this Agreement, Owner will not interfere with Licensee’s exercise of rights granted herein.

5. Termination
Licensee or Owner may terminate this Agreement at any time upon notice to the other. If Owner terminates pursuant to this provision, Owner shall not be forced to refund to Licensee the pro rata portion of any unused fees paid to Owner for the rights granted in this Agreement. If Licensee terminates pursuant to this provision, Licensee is not entitled to any refund of unused fees. This Agreement shall automatically terminate if Licensee breaches or defaults in the performance of any material covenant or obligation to Owner.

6. No Warranty, Indemnification
OWNER MAKES NO REPRESENTATION OR WARRANTY ABOUT THE PROPERTY OR ANY RIGHTS GRANTED HEREUNDER. ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY DISCLAIMED. Licensee agrees that the rights granted herein are exercised at Licensee’s risk. Licensee agrees to release and hold Owner harmless for any injury, loss or damage suffered by Licensee while exercising any rights granted in this Agreement, except for any injury, loss or damage resulting from any intentional act or gross negligence of Owner. Licensee agrees to indemnify and hold Owner harmless from any and all losses, claims, suits, injuries and damages resulting from or in any way connected with Licensee’s use of the Property or exercise of any rights in this Agreement.

7. Owner’s Rights
Nothing in this Agreement shall prevent or restrict Owner, Owner’s staff/employees and invitees, from using the Property as they see fit.

8. Governing Law
This Agreement is to be governed by, construed and enforced according to the laws of the State of Florida.

9. Final Agreement
This Agreement terminates and supersedes all prior understandings or agreements on the subject matter hereof. This Agreement may be modified only by a further writing that is duly executed by both parties.

IN WITNESS WHEREOF, the parties hereto executed this Property Use Agreement as of the date first above written.

Rules and Regulations



1. Rule: There will be no riding on landowner’s private property without express permission from individual landowner. This includes riding up on the banks to avoid water hazards, or to go around trees, etc.

Consequence: Fine to be set at $500.00 and license revoked for one year.


2. Rule: There will be no littering of the Alapaha River bottom while riding. Licensee must furnish garbage bags to contain what waste they produce while riding and such waste will not be left on the river bottom and will be disposed of properly by Licensee.

Consequence: Fines will be in accordance with state law in addition Licensee will lose license for one year.


3. Rule: There will be no driving under the influence of alcohol or drugs in accordance with state law. Passengers are exempt.

Consequence: Fines and/or arrest will be in accordance with state law in addition Licensee will lose license for one year.



All Rules, Regulations and Consequences will be adhered to by all Licensees and guests of Licensees.



the Suwannee River Water Management District has started to enforce the law on river bottom riding. we are trying to get them to sell permits to ride the river.

Interesting. Finally a step in the right direction for 4x4 legal access. Might need a tall snorkel right now tho :shock:

Step in the right direction but $100.oo to ride there is just insane for some of us that might ride there once a year.

Guess u can do drugs there as long as u dont drive :)

I've never been there, so how often does the river have no water in it to be a dry river bed ? :scratch: Sounds like more goverment fast talk to say you can do something when, then when never comes. :furious:

Dave, parts of it dry up. It's hard to tell when the water will go down or when it'll flood. Not really any set cycle. Maybe those who live closer can elaborate further on the tides lol

We've camped in the river bed before. Dry as a bone. Linz was making "snow angels" in the sand in the middle of the "river". lol Rode it several times. You can go as far as you can in either direction until the water gets too deep. Several miles the last time we were there.

But for $100? I'd rather use that to pay for some fuel up to riverrock or similar. :drive:

I wonder what the fine is for wheeling without a permit. Might be cheaper for us once a year users :lol:

Fines start at $150.00 and go up to $500.00. We use this area several times a year. I think its a worth while cause. The price of the permit may be negotiable. We are just trying to let the authority know that we are serious and want to watch after a place that we can ride. Just my two cents worth

i rode there a long butt time ago and flopped my jeep on its side in a gulee, that place was fun. 100 is a lot, I wonder how much it can be talked down.

I'll pay a $100. If I go 4 times a year its worth it. Also its beter than going to HardRock that dude is a pain in the :grin: .
